Why families choose Elmgrove

An estate plan is a letter to the people you love — written while it can still be heard.

Most disputes over an estate are not really about money. They are about a wish that was never written down, a document no one could find, a signature that came a year too late.

Our work is deliberately quiet: to make sure that when the time comes, your intentions are plain, valid and difficult to argue with — so the people you love are left with clarity instead of a quarrel.

Counsel that outlives the conversation. The Elmgrove principle

01

One family at a time

We take on a limited number of estates each year, so every will and trust is drafted by a partner — never passed down a chain of juniors.

02

Built to hold up

Every document is drafted to survive scrutiny — at a bank counter, a registrar's office, or, if it must, a courtroom.

03

Discretion, always

Estate matters touch the most private corners of a family. What you tell us stays within these walls, held in confidence.

Our practice

Four pillars of a settled estate.

Whether you are writing your first will or untangling an inheritance left without one, each of these has a clear path — and a partner to walk it with you.

I

Wills

A will is the difference between your wishes and a stranger's formula. We draft clear, valid wills — simple or layered — covering guardianship of minor children, specific bequests, the residuary estate and executors you can trust. We also review and update wills as your family and your assets change.

  • Testamentary wills
  • Codicils & updates
  • Guardianship clauses
  • Executor guidance
  • Registration & safe custody

II

Trusts

A well-made trust lets you provide for a child, a dependant with special needs, or a business — on your own terms, and often outside the friction of probate. We structure private and family trusts, draft the deeds precisely, and advise trustees on the duties they take on.

III

Succession

Passing on a home, a business or ancestral property is rarely simple across a large family. We plan succession so control transfers cleanly, stamp and tax implications are anticipated well in advance, and the people you name are the people who actually inherit.

  • Business succession
  • Gift & settlement deeds
  • Nomination & power of attorney

IV

Probate

When someone passes, their estate must be proved and administered before it can be shared. We obtain probate and letters of administration, guide executors through their obligations, and settle estates — with or without a will — with as little strain on the family as the law allows.

  • Probate petitions
  • Letters of administration
  • Estate administration
  • Intestate succession
  • Asset & title transfer

How we work

From first conversation to a plan your family can hold.

You will always know where matters stand and what happens next. Most estate plans move through four unhurried steps.

  1. I

    A confidential first meeting

Free and without obligation. Tell us about your family, your assets and your worries. We listen, then tell you honestly what you do — and don't — need to do.

  2. II

A clear picture of your estate

We take stock of property, accounts, businesses and dependants, and flag anything — from unclear title to a missing nominee — that could cause difficulty later.

  3. III

    Documents drafted to last

We draft the will, trust or deed in plain, precise language, walk you through every clause, and see it correctly signed, witnessed and, where wise, registered.

  4. IV

    Kept, and kept current

We hold your documents in safe custody and revisit them as the law, your family or your assets change — so your plan never quietly goes out of date.

Questions, answered plainly

What most families ask us first.

If your question isn't here, ask us directly — no question is too small, and the first conversation is free.

Do I really need a will if my family is close?

Yes — especially then. Without a will, the law, not you, decides who inherits and in what share, and even close families can fracture over an outcome no one intended. A clear will is the simplest gift you can leave the people you love.

What happens to an estate if there's no will?

It passes under the rules of intestate succession that apply to your community, in fixed shares that may not match your wishes at all. The estate must still be administered — usually more slowly, and at greater cost, than if a valid will had existed.

How is a will made legally valid?

Broadly, a will must be in writing, signed by you with testamentary intent, and attested by two witnesses who see you sign. Registration is optional but often prudent.

We handle each of these steps carefully and keep the signed document in safe custody so it can be found when it is needed.

What's the difference between a will and a trust?

A will takes effect after you pass and usually goes through probate. A trust can take effect during your lifetime, lets you set conditions on how and when assets are used, and often passes property outside probate. Many families use both, and we'll help you decide what fits yours.

Do you handle probate and inheritance disputes?

We do. We obtain probate and letters of administration, administer estates, and advise where an inheritance is contested — always trying to settle within the family before a matter reaches a courtroom.

Is the first consultation confidential?

Entirely. Your first conversation is free, private and without obligation. Everything you share is protected and stays between you and the firm.
